Terms of Service

Effective date: July 19, 2026

1. Acceptance of Terms

By downloading, installing, or using Hooly ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms apply to all users of Hooly, including free users, subscribers, and those purchasing credits. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Description of Service

Hooly is an AI image application that allows you to:

  • Generate images from text prompts using AI models
  • Edit and transform images using tools such as edit, upscale, reframe, erase, control-light, and background-remove
  • Upload reference or source images to use as input for a generation
  • Store and manage your generated images

Features and availability may change. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Accounts

  • You must create an account to use Hooly. You are responsible for maintaining the security of your account credentials
  • You must be at least 13 years old to use the App. By creating an account you represent that you meet this requirement
  • You are responsible for all activity that occurs under your account

4. Credits, Subscriptions & Billing

  • Hooly offers a premium subscription (Hooly Pro, available monthly or yearly) and consumable credit packs. Generating and editing images consumes credits
  • Purchases are processed and managed through the Apple App Store or Google Play via RevenueCat, subject to the store's terms
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Apple ID or Google Play account settings
  • Credit packs are one-time, consumable purchases. Credits that have been used are non-refundable, and we are not able to issue refunds for partial billing periods; refund requests must be directed to Apple or Google

5. Acceptable Use

You agree not to use Hooly to generate, upload, or distribute:

  • Content that is illegal or that facilitates illegal activity
  • Child sexual abuse material (CSAM) or any content that sexualizes minors
  • Sexual, intimate, or nude imagery of real, identifiable people without their consent, including non-consensual deepfakes
  • Content that impersonates a real person or misrepresents them in a harmful or deceptive way
  • Content that infringes the intellectual property, privacy, or other rights of others
  • Hateful, harassing, threatening, defamatory, or violent content

You also agree not to attempt to circumvent usage limits, gain unauthorized access to our systems or other users' data, reverse engineer the App, or interfere with the service. Violation of these rules may result in immediate suspension or termination of your account.

6. User Content & Reference Images

You are solely responsible for the prompts you enter and the images you upload. By uploading a reference or source image, you represent and warrant that you own it or have all necessary rights and permissions to use it, and that its use does not violate any law or third-party right.

You grant Hooly a limited license to process, transmit, and store your prompts and images solely to provide the service to you (for example, forwarding them to AI providers and storing your generations).

7. AI-Generated Content

Images and text generated by AI within Hooly may be inaccurate, unexpected, or similar to content produced for other users. AI output should not be relied upon as professional advice. We do not guarantee that any generated image is unique or free of similarity to existing works.

To the extent permitted by applicable law and the terms of the underlying AI providers, you own the images you generate. You are responsible for how you use them and for ensuring that your use is lawful.

8. Third-Party AI Providers

Hooly routes your prompts and images to third-party AI providers (including fal.ai, OpenAI, and OpenRouter) to fulfill your requests. Your use of these providers through Hooly is subject to their respective terms of service and usage policies. We are not responsible for the content, accuracy, or actions of any third-party AI model.

9. Intellectual Property

Hooly, its logo, design, and underlying software are owned by Hooly AI and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our written permission.

10. Disclaimer of Warranties

Hooly is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, Hooly AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or harm resulting from your use of the App or any AI-generated content.

Our total liability for any claim arising from your use of Hooly shall not exceed the amount you paid for the service in the 12 months preceding the claim.

12. Termination

You may stop using the App at any time and delete your account by contacting us. We may suspend or terminate your access if you violate these Terms, without prior notice.

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will do so, including sections on intellectual property, disclaimers, and limitation of liability.

13. Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
